1-1-8. Treatment.
(a) The Tribal Court may require an offender to undergo batterer’s
treatment, at the offender’s expense, in an authorized program approved by the
Tribe that accepts court-ordered participants and voluntary participants. An
offender ordered to treatment shall receive a minimum of 6 months or 52 hours of
treatment for a first offense, and 12 months of treatment for a second or subsequent
offense. The program may include the following services:
(1) Offers intake, orientation and placement in a domestic violence reeducation
class and other programs designed to provide information and
intervention to stop domestic violence.
(2) Utilizes appropriate cultural information in re-educating offenders of
domestic violence regarding responsible family and community behavior in
the Native American context.
(b) All court-ordered participants shall report back to the Court, or
agency or officials designated by the Court, to confirm that the participant has
successfully completed the ordered treatment.
( c) The Domestic Violence Advocate shall inform the victims of any
programs available to assist the victims and their children, which program may
include, advocacy, shelter, crisis intervention, supportive services and referral.
