5.7 1 0. Domestic Violence. […] F. Duties of Law Enforcement Officer to Victims of Domestic Violence; […] Required
Notice to Victim. Immediately fol lowing a domestic violence arrest, the law enforcement officer
shall advise all known victims of the availability of victim assistance programs and shall give the
victims information describing their legal rights and available services. The law enforcement
officer shall advise the victim(s) of the avai lability of an emergency order of protection as
provided under Section 5.7 1 2, Emergency Order of Protection. A domestic violence advocate,
shelter advocate, or behavioral health services may be called on behalf of the victim. Upon
request of the victim, the law enforcement officer or crime victim advocate shall provide or
arrange for transportation of the victim to a medical fac il ity or a place of shelter.
1. A law enforcement officer who responds to an allegation of domestic violence
shall use all reasonable means to protect the victim and others present from
further violence and has a duty to arrest, upon finding probable cause to bel ieve that domestic violence has occurred, subject to the provisions of Section 5.71 0.D.,
Arrest. A law enforcement officer need not obtain a search warrant in order to
enter a residence where he has probable cause to bel ieve an offense of domestic
violence is occurring or has j ust occurred. Such means include but are not l imited
to:
a. Taking the action necessary to provide for the safety of the victim and any
fami ly or household member as described in Section 5.71 0.B.;
b. Confiscati ng any weapon involved in the alleged domestic violence;
c. Transporting or obtaining transportation for the victim and any child(ren)
in obtaining medical treatment, including obtaining transportation to a
medical facility;
d. Assisting the victim in removing essential personal effects;
e. Assisting the victim and any child(ren) in obtaining medical treatment,
including obtaining transportation to a medical facility;
f. Giving the victim immediate and adequate notice of the rights of victims
and/or the remedies and services available to victims of domestic violence.
