5.14.020 Substance Abuse Evaluation Required.

a) Any offender who commits an offense involving alcohol or drugs shall be required as a part of his or her sentence to obtain a substance abuse evaluation and follow any and all treatment recommendations.

b) An offense shall be deemed to involve alcohol or drugs if:

1) The offense is included in Chapter 5.10, Alcohol and Drug offenses;

2) The offender was under the influence of, or in possession of, alcohol or drugs at the time the offense was committed;

3) The offender engaged in offensive conduct in order to obtain drugs; or

4) The offender engaged in offensive conduct in order to obtain alcohol and the offender is under the age of twenty-one (21).

c) The court shall set a date by which time the offender must provide to the court proof of having engaged in a substance abuse evaluation, and the offender will be responsible for submitting proof of compliance with the evaluation and any recommended treatment.

d) An offender’s willful failure or refusal to comply with a court-ordered substance abuse evaluation and treatment shall constitute criminal contempt of court punishable as provided by the laws of the Muckleshoot Indian Tribe. If the court suspended any part of the sentence on the condition that the offender undergo substance abuse treatment, the court may also impose the suspended sentence.
