5.29.030 Traditional Punishments.
There is a presumption that imposition of a traditional punishment instead of or in addition to jail or a fine is in the best interest of the Tribal community and defendant, except where the defendant has committed a violent or sexual offense. Such punishments may include, but are not limited to:
a) Participation in an alternative sentencing program;
b) Community service for the benefit of the Tribal community;
c) Participation in any supervised rehabilitation, diagnostic or therapeutic evaluation or program, which may include mental health, chemical dependency or other appropriate treatment, counseling, training or education;
d) Participation in other programs or services, including community, cultural and spiritual events; and
e) Payment of restitution in a specified manner for harm or loss caused by the offense. If agreed by the victim and ordered by the court, restitution may take the form of service to the victim or to a tribal program; and
f) Temporary voluntary exclusion from the Reservation or a certain area of the Reservation.
