9-7.28 PUBLIC DRUNKENNESS
It shall be the policy of the Kalispel Reservation in concurrence with the provisions of RCW 70.96A, that alcoholics and intoxicated persons within the jurisdiction of the Kalispel Reservation may not be subjected to criminal prosecution solely because of their consumption of alcoholic beverages and that such individuals, upon detention by a law enforcement officer, shall be placed in protective custody towards the end that such individual be made available for participation in an alcoholic rehabilitation program under the Washington State Department of Social & Health Services in accordance with RCW 70.96A.
