Sec. 5-5-22 Dispositional Alternatives
If the minor has been adjudicated a juvenile offender, the plan of disposition and treatment may provide for:
A. Placement of the child on probation with the supervision of the probation officer or other designated Court official.
B. May require the child, as a condition of the probation, to report for assignment to a supervised work program, which program shall be a constructive nature designed to promote rehabilitation, appropriate to the age level and physical ability of the child, and shall be combined with counseling from a probation officer or other designated Court official.
C. May require, at the discretion of the Juvenile Judge, as a condition of probation, that the juvenile offender be held in a jail facility up to fifteen (15) days, such detention to be in a cell separate from adult prisoners or inmates, under adequate twenty-four (24) hours a day supervision.
The dispositional order entered hereunder, however, shall not deprive a child of schooling appropriate to his age, needs and specific rehabilitative goals.
Dispositional orders are to be in effect for a time limit set by the Juvenile Court but such orders shall not continue after the child reaches the age of eighteen (18) years of age.
Dispositional orders are to be reviewed at the Juvenile Court’s discretion, but shall be reviewed at least once every three (3) months. […] Sec. 5-5-23 Modification Of Dispositional Orders
A dispositional order of the Juvenile Court may be modified upon a showing of a change of circumstances upon motion of the minor, or the minor’s parents, guardian, or custodian, or the Juvenile Court Prosecutor (Presenting Officer), or Court, or its designated officers.
A hearing to modify dispositional orders shall be conducted after written notice of such hearing shall be given to the minor, the minor’s parents, guardian or custodian and the minor’s counsel at least five (5) days prior to the hearing and which notice shall contain the name of the Court, the title of the proceedings, a statement that the hearing is to modify the dispositional order, and the date, time and place of the hearing. Such notice shall be delivered by a Tribal law enforcement officer or a designated Court official.
