Sec. 406. Diversion Before Trial.
(a) Diversion Authorized. The Tribal Prosecutor may recommend a diversion
program, including counseling or treatment. The Chitimacha Tribal Court may approve such a
recommendation before trial and without a hearing in its discretion and in the interests of justice
and fairness.
(b) Limitations. A defendant who successfully completes the diversion program
shall not be deemed guilty of the crime charged for any purpose. In cases of Domestic Violence,
the Court shall not approve recommendations for any diversion or remedial action that would put
the victim in the position of dealing directly with the offender, even if the victim has the right to
decline to participate, in accordance with Section 621 of Title III.
