(2) Delinquent children. In cases where the child has no previous record of
delinquency and the child is alleged to have committed a misdemeanor, the
personnel authorized may recommend a diversion program, including counseling
or treatment, in the best interests of the child. The Court may in its discretion
approve such recommendation without a hearing. A child who successfully
completes the diversion program shall not be deemed a delinquent for any purpose.
No diversion program shall exceed six (6) months
