Informal Resolution of Delinquency Cases

An informal resolution program shall consist of one or more mediation sessions facilitated by the Juvenile Prosecutor in which the juvenile and his or her parent, guardian, or custodian work with the Juvenile Prosecutor to formulate and implement a written plan. The mediation session(s) shall be attended by the juvenile and his or her parent, guardian, or custodian. Other interested persons may attend at the discretion of the Juvenile Prosecutor. The written plan shall consider a number of alternatives to a formal jurisdictional hearing in Juvenile Court. Alternatives shall include, but are not limited to, the following: (a) Refer the juvenile and the parent, guardian, or custodian to a community agency for needed assistance; (b) Order terms of supervision, calculated to assist and benefit the juvenile and the community, that regulate the juvenile’s activities and that are within the ability of the juvenile to perform; (c) Accept an offer of restitution if voluntarily made by the juvenile. An informal resolution program shall not exceed eleven (11) months in duration. The Juvenile Prosecutor shall, during the course of the informal resolution program, review the juvenile’s progress every thirty (30) days.
