Pre-Sentence Report in Cases Involving Minors
(1)
The probation officer shall prepare a written report describing all reasonable and
appropriate alternative sentences. The report shall contain a specific plan for the care of and
assistance to a defendant under eighteen (18) years of age calculated to resolve the problems
presented by the complaint, circumstances surrounding the crime, and matters related to the
crime which may assist the court in sentencing.
(2)
The report shall review the performance of the minor, the minor’s parents,
guardian, or custodian and persons providing assistance to the minor and the minor’s family, as
well as a detailed explanation showing the basis for proposing the sentence, the benefits to the
minor, and the manner in which the proposal is consistent with the interests of the Tribes.
(3)
The probation officer shall present the pre-sentence report to the court, the
prosecutor, the minor, the minor’s parents, guardian, or custodian and the minor’s legal counsel
at least three (3) days before the sentencing hearing
