D. Referral for Treatment
1. In place of, or in addition to, a civil penalty, the Tribal Court, at its
discretion, may refer a violator to mental health providers including an
alcohol/substance abuse program, and/or social services program for an
evaluation, counseling and/or treatment.
2. After completion of an evaluation, the agency conducting the evaluation
shall report its findings and recommendations to the Tribal Court or an
officer assigned by the Tribal Court.
3. The Tribal Court may order mental health providers to submit progress
reports of treatment. An officer assigned by the Tribal Court will monitor the person’s progress in his or her treatment program.
4. Residential treatment facilities are an option for persons violating this
Ordinance if so requested by the person and if recommended by an
authorized mental health or other treatment agency.
