§ 2.8.02 Arraignment Continued – Referral to Treatment Facility The arraigning judge on consideration of the request may continue the arraignment to
refer such person for a diagnostic evaluation to an alcohol, drug, or mental health program, as
indicated. Such program shall conduct an investigation and examination to determine whether
the person suffers from the problem alleged, whether the problem is such that if not treated there
is a probability that similar misconduct will occur in the future, whether extensive and long term
treatment is required, and whether effective treatment for the person’s problem is available. The
program shall make a written report to the Tribal Court stating its findings and recommendations
and, if the findings and recommendations support treatment, including a treatment plan setting
out the type, nature, length, and treatment time schedule. This report shall be filed with the
Tribal Court and a copy given to the defendant.
