Part I(k) TRIBAL MEMBER REVIEW BOARDS (“TMRBs”).
(1) Subject to available funding, one or more TMRBs may be established to review the cases of children who are wards of the Tribal Court and make recommendations to the Juvenile Court.
(2) TMRB members shall be volunteers, and shall not be compensated for their time, but may be reimbursed for mileage at the Tribal rate.
(3) The Chief Judge shall compile a list of applicants qualified to serve on a TMRB and shall present the list to Tribal Council for approval. The Chief Judge shall appoint TMRBs consisting of a least three (3) and no more than five (5) members from the approved list.
(4) Qualifications for TMRB Members.
(A) Age and Experience. Each member of the TMRB shall be a Tribal member twenty-one (21) years of age or older, preferably living within Polk, Yamhill, Tillamook, Washington, Multnomah, or Marion counties, and have special knowledge, background and/or experience in one more of the following: (i) parenting or foster care; (ii) Tribal custom and tradition; (iii) juvenile law; (iv) health care; (v) mental health care; (vi) social work; or (vii) education.
(B) Training. A member of the TMRB shall complete orientation and continued training as established and directed by the Court. Members shall complete twenty-four (24) hours orientation training prior to commencing TMRB activity. Members shall complete at least ten (10) hours continued training each year in which he/she serves as a TMRB member and other training as directed by the Court.
(C) Oath. Each member shall swear or affirm to the Court, under oath, that the member shall perform his/her duties as required, and shall keep confidential the information reviewed by the TMRB and the TMRB’s actions and recommendations in individual cases.
(7) TMRB Review.
(A) All parties, including children twelve (12) years of age or older and foster parents, shall be notified of their right to appear and be heard at the hearing.
(B) Each TMRB shall review cases as assigned by the Court, and the TMRB coordinator shall set dates for review of each case assigned; provided, however, the first review shall be conducted no more than six (6) months after the Court’s order following disposition and no less frequently than once every six (6) months thereafter, unless directed otherwise by the Court.
(E) The TMRB may request parents, guardians, custodians, foster parents, the child, attorneys, and any other individual the TMRB deems necessary, to participate in a case review. Before participating in a case review, each participant shall swear or affirm to the TMRB that the participant shall keep confidential the information disclosed in the case review.
(8) Findings and Recommendations of the TMRB.
(A) Written Findings and Recommendations. Within five (5) days of a case review, the TMRB shall prepare and issue written findings and recommendations to the Court and CFS or guardian, as applicable.
