Victim Conference with Prosecutor and Victim Advocate

Tribe: Confederated Tribes of the Warm Springs Reservation of Oregon

Upon request of the victim, the prosecutor and victim advocate shall confer with the victim about the disposition of a criminal offense, including the victim’s views about a decision not to proceed with a criminal prosecution, a dismissal, a plea, or sentence negotiations and a pretrial diversion program. Upon request of the victim, the prosecutor and the victim advocate shall confer with the victim before the commencement of the trial. The right of the victim to confer with the prosecutor and victim advocate does not include the authority to direct the on-going prosecution or dismissal of the case.
