A victim’s right to be heard may be exercised, at the victim’s discretion, through an oral statement or submission of a written statement to the Court. A victim impact statement submitted to the court may include the following: An explanation of the nature and the extent of any physical, psychological, or emotional harm or trauma suffered by the victim; An explanation of the extent of any economic loss or property damage suffered by the victim; An explanation of the need for and extent of restitution. Upon request of the victim, the victim has the right to be present and be heard at any proceeding in which a negotiated plea for the person accused of committing the criminal offense against the victim will be presented to the court. At any disposition proceeding, the victim has the right to be present and to address the Court. The victim may present evidence, information, and opinions that concern the criminal offense, the defendant, the sentence, and the need for restitution. The victim has the right to be present and heard at any probation/parole revocation proceeding or any proceeding in which the court is requested to terminate the probation/parole of the defendant.
